Plain-English summary: use the site and our services lawfully, provide accurate information, understand that used-game inventory and pricing can change quickly, and follow any specific terms given for trades, repairs, arcade use, parties, promotions, gift cards, store credit, or other services.
1. Acceptance of These Terms
These Terms of Service (the “Terms”) are a binding agreement between you and Planet Retro Video Games (“Planet Retro,” “we,” “us,” or “our”). They apply to your access to and use of planetretrovideogames.com (the “Site”) and to online features made available through the Site.
Some in-store or transaction-specific services may also be subject to additional written or posted terms, including repair intake terms, trade-in acknowledgments, layaway terms, party or event terms, warranty terms, promotion rules, and arcade rules. If a transaction-specific term conflicts with these Terms, the more specific term controls for that transaction to the extent of the conflict.
By using the Site, creating an account, submitting a form, placing an order where available, or using a service that expressly incorporates these Terms, you agree to them. If you do not agree, do not use the affected Site feature or service.
2. Our Services
Planet Retro is a retail video game and collectibles business and operates Retroware Arcade. Depending on availability, our Site and store may support retail purchases, inventory browsing, trade-in requests, repairs, disc resurfacing, layaways, customer accounts, wishlists, item notifications, loyalty features, gift cards, store credit, events, parties, and arcade access.
Features may be added, changed, suspended, or discontinued. Availability shown online is informational and may change before an item, appointment, reservation, or service is confirmed.
3. Customer Accounts and Account Security
Where account features are available, you agree to provide accurate information and keep your login credentials secure. You are responsible for activity performed through your account unless prohibited by law. Notify us promptly if you believe your account has been compromised.
We may restrict or disable an account when reasonably necessary to protect customers, prevent fraud or abuse, comply with law, or protect the integrity of our systems.
4. Products, Inventory, Condition, Pricing, and Availability
Much of our inventory is pre-owned, collectible, limited, or one-of-a-kind. Product availability, condition, completeness, market value, and pricing can change quickly. We make reasonable efforts to present information accurately, but photographs, descriptions, prices, inventory counts, grading notes, and availability may contain errors or become outdated.
We may correct errors, cancel or decline a transaction affected by an obvious error, limit quantities, or update pricing before a transaction is finalized, subject to applicable law. Unless a specific written warranty or return policy says otherwise, pre-owned or collectible items are sold in their stated condition.
Images may be representative rather than the exact unit unless the listing states otherwise. Collectible grading and condition assessments involve judgment and may differ from third-party grading services or another buyer’s opinion.
5. Payments, Taxes, Refunds, and Order Fulfillment
We may accept cash, cards, digital wallets, third-party payment services, gift cards, store credit, financing or installment options, or other methods that are enabled at the time of purchase. Payment processing may be performed by third-party providers under their own terms and privacy policies.
You authorize us and our payment providers to charge the amount presented to you, including applicable taxes, fees, shipping, deposits, or other disclosed charges. Refunds, returns, exchanges, deposits, cancellations, and fulfillment are subject to the policy disclosed for the applicable transaction and applicable law.
If online ordering, pickup, shipping, or delivery is offered, estimated timing is not guaranteed. Risk of loss and title transfer will be handled as required by applicable law and any transaction-specific shipping terms.
6. Trade-Ins, Buybacks, and Selling Items to Us
Online trade requests, estimates, or preliminary values are not final offers. Final offers are determined after physical inspection and, where appropriate, testing. Value may depend on condition, completeness, authenticity, market demand, current inventory needs, and other legitimate business factors.
By selling or trading property to us, you represent that you own the property or are authorized to transfer it, that it is not stolen or subject to an undisclosed lien or claim, and that information you provide about it is accurate. We may require identification or additional information when required by law or store policy.
We may decline any item or transaction. Cash and store-credit offers may differ. Once a trade or sale to us is finalized, ownership transfers according to the paperwork or receipt provided at the time of the transaction.
7. Repairs, Disc Services, and Customer Property
Repair, resurfacing, diagnostic, shipping, and customer-property services may have separate intake terms that describe estimates, deposits, parts, data risks, turnaround times, warranties, pickup, shipping, storage, and unclaimed-property procedures. Those specific terms control the service.
Before leaving a console, device, storage media, or other equipment with us, you should back up data and remove sensitive information where practical. Repair work can reveal additional problems, and estimates may need to be revised with your approval where required.
We will use reasonable care with customer property in our possession, but no service can eliminate every risk of data loss, latent hardware failure, shipping damage, or pre-existing defects. Nothing in these Terms limits rights that cannot legally be limited.
8. Retroware Arcade, Wristbands, Parties, and Events
Arcade access is subject to posted pricing, hours, capacity, re-entry rules, wristband requirements, machine availability, safety rules, and employee instructions. Wristbands or other access credentials are for the person and period for which they were issued and may not be transferred unless we allow it.
You agree to use arcade equipment responsibly, follow posted rules, and avoid conduct that is unsafe, abusive, disruptive, destructive, or interferes with other guests. Food and beverages must remain in permitted areas. A machine may be unavailable because of maintenance, rotation, repair, events, or other operational needs.
Party and event reservations may be subject to separate booking, deposit, cancellation, capacity, supervision, and conduct terms. Parents and guardians remain responsible for minors in their care except where applicable law provides otherwise.
9. Loyalty Rewards, Store Credit, Gift Cards, Layaways, and Promotions
Loyalty points or “Gems,” store credit, gift cards, layaways, promotional discounts, coupons, and similar benefits are subject to the rules disclosed when issued or used. We may establish reasonable eligibility, redemption, exclusion, anti-fraud, and expiration rules, subject to applicable law.
Store credit, loyalty value, promotional value, and gift cards are not redeemable for cash except where required by law. Lost, stolen, altered, duplicated, or fraudulently obtained credentials may be restricted or declined to the extent permitted by law.
Promotions may have exclusions, quantity limits, dates, eligible categories, or other conditions. If promotional terms conflict with these Terms, the promotion’s specific terms control for that promotion.
10. Email, Text, and Other Communications
If you choose to join a mailing list, request item alerts, opt into promotional communications, or otherwise consent to marketing, you authorize us to send the communications described at the time of consent. Marketing consent is not a condition of purchase unless expressly permitted by law.
You can unsubscribe from marketing emails through the unsubscribe link provided in the message. Transactional, security, account, repair, pickup, order, or service communications may still be sent when reasonably necessary to provide a service you requested.
11. Acceptable Use
You may not misuse the Site or our systems. Prohibited conduct includes attempting unauthorized access, interfering with security or availability, introducing malware, scraping or harvesting data in a manner that violates law or our rights, impersonating another person, submitting fraudulent requests, abusing promotions or loyalty systems, or using the Site to violate another person’s rights.
We may investigate suspected misuse and take reasonable protective action, including limiting access, canceling fraudulent transactions, or preserving information when legally permitted.
12. Intellectual Property
The Site, its design, software, text, graphics, logos, original photography, branding, and other original content are owned by Planet Retro or used with permission and are protected by applicable intellectual-property laws. Third-party game, console, character, publisher, manufacturer, payment-provider, and other marks belong to their respective owners.
You may use the Site for personal, non-commercial purposes. You may not copy, republish, sell, reverse engineer, or create derivative commercial uses of our original Site content or software except with written permission or as permitted by law.
13. Third-Party Services and Links
The Site may link to or integrate with services operated by third parties, including payment processors, maps, social platforms, marketplaces, booking tools, analytics providers, and other service providers. Their products, services, terms, privacy practices, and availability are controlled by them, not Planet Retro.
A link or integration does not mean we endorse every statement, product, or practice of a third party.
14. Disclaimers
To the maximum extent permitted by law, the Site and its general informational features are provided on an “as available” basis. We do not guarantee that the Site will be uninterrupted, error-free, or free from all security risks, or that every inventory item, price, market estimate, third-party data point, or availability indicator will always be current.
Nothing in these Terms disclaims warranties, remedies, consumer rights, or liabilities that cannot legally be disclaimed or limited.
15. Limitation of Liability
To the maximum extent permitted by law, Planet Retro and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of the Site or loss of access to the Site.
For claims arising from a paid transaction, any limitation of liability will be applied only to the extent permitted by applicable law and will not limit liability that legally cannot be limited, including liability based on willful misconduct or other non-waivable rights.
16. Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims caused by your unlawful misuse of the Site, your material breach of these Terms, or your infringement of another person’s rights. This provision does not require a consumer to indemnify Planet Retro for Planet Retro’s own unlawful conduct.
17. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where federal law or another jurisdiction’s mandatory consumer law applies.
Before filing a lawsuit concerning the Site or a transaction, we encourage you to contact us so we can try to resolve the issue. Any dispute that is not resolved informally may be brought in a court of competent jurisdiction as permitted by applicable law.
18. Changes, Severability, and Entire Agreement
We may update these Terms from time to time. The “Last Updated” date will identify the current version. Material changes will be communicated when required by law. Changes apply prospectively unless the law permits otherwise.
If a provision is found unenforceable, the remaining provisions remain in effect to the extent allowed by law. These Terms, together with applicable transaction-specific terms and policies, form the agreement governing the covered services.
